The saga continues with the Dothan Personnel Board`s investigation forced resignation of former police captain, Jim Smith.
Yesterday, Judge Larry Anderson held a hearing in a Houston County Courtroom to listen to a complaint filed by the plantiff`s attorney Banks Smith. Smith thinks the other side is in contempt of court. He argued that the Citizens Supervisory Committee and Personnel Board are in contempt because they have forged ahead with parts of the investigation that he says were clearly banned in Judge Anderson`s July 28th advisory opinion.
At that time there was no understanding that they would not pursue their investigation. In fact, they voted to authorize the Personnel Board to go ahead and investigate the ten things listed in the report that was already submitted to the court, according to Attorney Banks Smith.
Judge Anderson heard both sides, but made no ruling. He did give Attorney Smith ten days to file a response to the defendants stated case laws and language used in their appeal.
