Desmonte Leonard's Attorneys Request Return To The Crime Scene

By: Stephen Crews
Updated: June 27, 2012

Attorneys for accused Auburn shooter, Desmonte Leonard, want a judge to let their client view the scene of the crime.

Leonard faces three charges of capital murder and two counts of first degree felony assault.

Six people were shot outside an apartment complex in Auburn earlier this month.

Leonard's attorneys say it's necessary for his client to be there, because the case is complicated and they need to take pictures, measurements and further investigate the crime scene.

Leonard's attorneys filed the request late Monday. His attorney's argue that denial of the request would deny due process of law.

If a judge agrees, Leonard would be taken to the crime scene and then returned to the Montgomery county jail.

Leonard is in the Montgomery County jail, held without bond.

A date for his preliminary hearing has not been set.
